Licence

By ordering a Scribbbe account (Existing Customers) / by creating a Scribbbe account (New Customers) and upon acceptance of the General Terms, the Customer enters into a license agreement with Scribbbe with respect to the use of Scribbbe SOFTWARE.

Scribbbe grants the Customer a non-transferable and non-exclusive license to use Scribbbe SOFTWARE. The scope of the functionalities covered by the license depends on the type of account. The functionalities of each type of account are described in the Scribbbe SOFTWARE INFORMATION PAGE (Annex A). The Customer shall use Scribbbe SOFTWARE exclusively for its sole and unique benefit and in accordance with the intended use of 

The Customer acknowledges that Scribbbe SOFTWARE is constantly being improved by Scribbbe.  The Customer will only have access to the latest released version of Scribbbe SOFTWARE.  Each new version or update of Scribbbe SOFTWARE will replace the previous version thereof, and be subject to all rights and obligations as mentioned in the General Terms.  During the updates, Scribbbe SOFTWARE may temporarily be unavailable to the Customer.

Scribbbe reserves the right to temporarily suspend access to its Site and the Services available on it for :

  1. Scheduled or unscheduled maintenance ;
  2. Maintaining the security and/or integrity of the network of the Scribbbe, its associated equipment or systems or its third party suppliers; 
  3. Repair of problems or unplanned technical failures.

    Therefore, Scribbbe does not guarantee the availability of the website or any of the services offered on the website.

Scribbbe is under no obligation to update any information contained on the website. Scribbbe reserves the right at its sole discretion, to terminate access to all or part of the website or the Service with or without notice.

Since a free version is made available with the same functionalities and quality of service, with no time limit; Scribbbe does not promise any “money back garantee” or refund.

Licence Intellectual property

The use of the Internet Site Scribbbe is reserved except convention or specific and express license conceded by Scribbbe to a strictly noncommercial use.

The CUSTOMER acknowledges not to violate the business secret surrounding the know-how and the methods used by Scribbbe to deliver the Service, in particular concerning the methods of assembling different software and of creation of bridges in particular via source codes specifically created for this purpose.

Scribbbe preserves the whole, full and exclusive property of the various information/data/source codes transmitted within the framework of the Services under the various legislations as regards protection of copyright and related rights, trademarks and patents and in particular the legislations concerning the legal protection of the databases as well as all the trademarks, texts, comments, works, illustrations and images, whether visual or sound, reproduced on the site of Scribbbe or belonging to Scribbbe.

The Customer is prohibited, to reproduce, extract, decompile, reuse any element of the Service(s), by any means, in any form and on any support and to reuse them for commercial purposes or to create a similar service ;

Any unauthorized reproduction or representation of immaterial goods on which Scribbbe holds an intellectual property right, in whole or in part, is constitutive of counterfeiting which can engage the civil and penal liability of its author. 

The fact of affixing a hypertext link towards the site Scribbbe, by using the technique known as “framing” or “deep linking”, is strictly prohibited. 

Any total or partial reproduction of the catalog and/or the site of Scribbbe is strictly prohibited.

Limitations of liability

Scribbbe is only bound by an obligation of means. In general, Scribbbe will not assume any responsibility for loss of profit, damages resulting from a loss in the broadest sense of the term and/or any other direct or indirect damages of any nature whatsoever. In any event, Scribbbe can in no case be held responsible for the indirect damage undergone by the Users such as the loss of profit, the decrease in the turnover or any other increase in overheads, or the loss or degradation of data.

To the extent that Scribbbe is not able, by virtue of a legal provision, to be released from its entire responsibility, this responsibility will be limited in all cases to the damage resulting directly from the defect, and consequently foreseeable at the time of the subscription of the contract, it will be limited to an amount equivalent to 15% of the value of the current Order. 

Scribbbe shall in no way be held responsible for any damage not inherent to the Services resulting from an external cause, totally unrelated to Scribbbe, whether or not the Customer is at fault. 

If, in spite of the absence of defect inherent to the service and of damage resulting from an external cause, the responsibility of Scribbbe for the damages proved and undergone by the Customer was established, the limitations of responsibility quoted previously will be applicable.

The Customer is responsible for the correct use of the software, in accordance with the instructions and recommendations, and for the respect of the regulations in force, in particular as regards safety of private data.

Scribbbe provides its best efforts in terms of antivirus control. As the Scribbbe Website contains links to other sites, it declines any responsibility as for the damage generated by a computer virus contracted at the time of the visit of its Web site or at the time of exchanges of emails.

Scribbbe can also, from time to time, provide links to other websites of third parties which are not under the jurisdiction of Scribbbe These links are meant to provide supplementary information and do not mean that these pages and/or their content is supported by Scribbbe or that it is associated with the linked site in any manner. The content of the related website is not the responsibility of Scribbbe It is your obligation to review the terms and conditions of every other website that you might access.

We reserve the right, but are not obligated, to limit the sale of our products or services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services we offer. All product descriptions or product prices are subject to change at any time and without notice, at our sole discretion. We reserve the right to discontinue any product at any time. Any product or service offer made on this site is void where prohibited.

We do not warrant that the quality of any product, service, information or other material purchased or obtained by you will meet your expectations, nor do we warrant that any errors in the Service will be corrected.

Customer’s obligations and liability

The Customer is fully and solely liable for any and all operations performed under its account. Customer is responsible for the confidentiality of its account, usernames and passwords, for the access to its computer system and for any acts and negligence of any party making use of a Customer’s account. Customer shall not allow access to Scribbbe SOFTWARE to any person that is not a User.

In case Customer finds or suspects any misuse of its account information, Customer will immediately change its passwords.

The Customer shall comply with (i) all international, national, state and local laws and regulations, and (ii) all internet regulations, policies and procedures.

The Customer agrees to never use Scribbbe SOFTWARE for illegal purposes or conduct that is otherwise objectionable. The Customer may not process any content that (i) is unlawful, harassing, libelous, abusive, threatening, or harmful of any kind or nature or otherwise objectionable; (ii) it does not have the right to process under any law or under contractual or fiduciary relationships; (iii) infringes any rights of a third party, such as but not limited to patent, trademark, trade secret and copyright rights.

The Customer will not use nor display any means, software or routines that might harm other parties or the good functioning of Scribbbe SOFTWARE, or disproportionately burden the Scribbbe SOFTWARE system.

Scribbbe reserves the right to seek all remedies available including but not limited to blocking the access to an account, or to block access from a particular IP address.

The Customer accepts full responsibility for its account and agrees to defend, indemnify and hold harmless Scribbbe, its shareholders, directors, officers, employees, agents, distributors, attorneys, parent companies, subsidiaries and affiliates, from and against any and all claims, liabilities, judgments, penalties, taxes, costs and expenses (incl. reasonable attorney fees and costs) arising out of or related to Customer’s use of the Scribbbe SOFTWARE and/or breach of the General Terms.

Final Provisions

The fact that Scribbbe does not take advantage, at one time or another, of one of the provisions of these General Conditions will not be interpreted as a waiver by the latter to take advantage of it later.

In the event that one of the provisions of the General Terms and Conditions is declared null or ineffective, it will be deemed unwritten, without affecting the validity of the other provisions, unless the provision declared null or ineffective was essential and determined.

The electronic data stored in the information systems of Scribbbe relating to the Services proposed by Scribbbe are authentic between the parties, until contrary proof. These electronic data thus constitute admissible, valid and opposable proofs to the Customers under the same conditions and with the same probative force as any document which would be established, received or preserved on paper support.

Law and jurisdiction

The present General Conditions, and more generally the contract that You conclude with Scribbbe are subjected to the Belgian law. Any litigation relating to their interpretation and/or their execution falls under the jurisdiction of the commercial court of Brussels as regards the Professional Customers.

Annex A: Scribbbe Software information Page

Scribbbe SOFTWARE is an advanced and intelligent online transcription software.  Scribbbe SOFTWARE is internet-based.The available Scribbbe accounts are:

Demo Account:

This account is free of charge and can be access by app.scribbbe.com or demo.scribbbe.com.

The features are in principle the same as other account, built in the following limitations:
– A maximum of 5 minutes length files can be uploaded.

Scribbbe also reserves the right to limit the functionalities, and change the limitations of the accounts.

Life-time Account:

This account is not free and contains the following modules depending on the package purchased on scribbbe.com/life-time-deal/ :

2 hours: 

2 hours of free transcription credits per month. 

“hour” credits can be purchased at 50%.

4 hours: 

4 hours of free transcription credits per month. 

“hour” credits can be purchased at 50%.

8 hours: 

8 hours of free transcription credits per month. 

“hour” credits can be purchased at 50%.

16 hours: 

16 hours of free transcription credits per month. 

“hour” credits can be purchased at 50%.

Normal account:
This account is not free and “hour credits” need to be purchased.
